Governing law and venue

These Terms, and any dispute, claim or controversy arising out of or relating to these Terms or to your access to or use of this website — whether sounding in contract, tort, statute or otherwise — are governed by and construed in accordance with the laws of the State of Kansas, without giving effect to any choice-of-law or conflict-of-law provision or rule that would cause the application of the laws of any other jurisdiction.

The exclusive venue for any such dispute, claim or controversy shall be the state or federal courts located in the State of Kansas. You irrevocably consent to the personal jurisdiction of those courts and waive any objection to the laying of venue in them, including any objection on the basis of forum non conveniens.

If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. No failure or delay in enforcing any provision of these Terms operates as a waiver of it.
